Venue for a Los Angeles worker with an Orange County lawyer
For a worker who lives and was hurt in Los Angeles County, Labor Code section 5501.5 points to that county twice, by residence on the filing date and by place of injury. Hiring a lawyer adds the county of the lawyer’s principal place of business, and because our office is in Newport Beach, Orange County becomes a second county to consider for the Application for Adjudication of Claim, the form that opens a case before a workers’ comp judge. An employer that objects within 30 days of getting the information request form naming Orange County sends the filing back to residence or injury. Within Los Angeles County, with its five offices, subdivision (b) calls for a location in the county that meets those tests and the worker’s written consent to it.

The DWC’s Uninsured Employers Benefits Trust Fund (UEBTF) South office is in the same building, Suite 690, 213-576-7300. The fund pays when an employer that was illegally uninsured fails to pay benefits the Workers’ Compensation Appeals Board awarded. The DWC says an application for adjudication should be filed before benefits are requested from the fund.

Kaiser Permanente leads with 44,769 employees, followed by the University of Southern California, Northrop Grumman, Cedars-Sinai Medical Center and Allied Universal; Target, Providence Health & Services, Ralphs/Food 4 Less/Kroger, Walt Disney Co. and Boeing complete the ten. The city notes that the figures come from the employers themselves.
